If you got delivery confirmation, that should help you as to your case. Also, REALLY push your side with ebay - phone calls and everything - to help prove your case. Don't be too passive here.

I've noticed since ebay has taking my rights away as a seller that the buyers are being a LOT more rude and demanding. The buyers know ebay lets them get away with murder

It's gotten a little better in the past 6 months or so - I think starting next month, it's harder for a buyer to leave automatic feedback and a few other nice advancements.

Getting pretty pissed when thinking about all this so I hope it doesn't sound to angry.
I have been lucky and only sold to nice people so far, no problems. Had to do a small refund once but that's all and I think it was legit. But as a buyer I have had to go through a lot of shit the last year.
I "recently" bought a b-wing, yellowed, broken 90% of the parts missing etc. Was gonna use the chassi for my other one after I had fixed it up. But it never arrived.
The seller claimed it was sent, I never got any proof at all. She couldn't give me any tracking information which I specifically asked for but when she sent it, she just said there was no tracking available... started getting suspicious here since I wanted to pay the extra cost.
Got delayed until I had to get rude with her to get a good response. Even stating I don't care if I get bad feedback in retaliation to the one I will leave. The broken b-wing was just 7$ not much at all but the shipping was 32$ so it still get pretty expensive for something that is badly yellowed, as incomplete it can get and don't even work.
Anyway after 2 months I was refunded 4dollars not even the small amount of 7dollars. Which just drove me nuts. I recently did a small refund of 17dollars and the paypal cost was like 0.7dollar.
I told her it was a joke, I didn't care about about 4 dollars not even the 7dollars, what I did care about was the 32$ shipping. I guess I was more pissed because I am 90% sure she never sent it at all and just took the shipping money and sent the thing down the dumpster.
Later she refunded me 7dollars for some reason... and told me to pay back the 10$ refund if the item arrived. Gone around 4-5 months now, still no b-wing.
I hate when stuff like this happen, I actually thought I lost 2 packages to Australia sometime ago but then they arrived. So for some reason when I send stuff arrives, but when people send to me 20% never arrive...

I always keep a seller on a short leash. If something doesn't arrive for a few weeks, I communicate and put a definitive time on something. If it doesn't happen, I go the complaint route through ebay.
Case in point: won a mint-in-bad-package Super Powers Parademon a few months back, paid quickly. Got a little runaround, never sent, gave a week's deadline and then filed. ALWAYS file before the ebay deadline if you are getting the runaround. Just tell someone that you're doing it as an abundance of caution, and you won't lose out on anything. If they don't ship and can't prove it, they don't win. About the only times I hear of something is when a seller sends a fraudulent tracking # or something similar.
Btw, sellers cannot leave negative feedback anymore, they can only file a non-paying bidder complaint if you don't pay, which goes away if/when you do.
